Section 125 is a provision of the Internal Revenue Code that allows employees to pay their share of the cost of certain group insurance benefits, unreimbursed medical expenses, and dependent care expenses with pre-tax dollars. Under this provision, your paycheck is reduced by the amount you elect for the year. That money is removed from your salary structure before Federal Income, State Income, and Social Security taxes are calculated. This results in lower taxable income, and higher take-home pay.
A Healthcare FSA is an employer-sponsored account letting employees set aside pre-tax dollars to pay for eligible healthcare expenses. It’s a smart way to save and pay for eligible healthcare expenses. With an HC-FSA, pre-tax funds are deducted from each paycheck and automatically deposited into the employee’s account.
Dependent Care FSA covers qualified daycare expenses for children younger than age 13 and adult dependents who are incapable of caring for themselves. An example of an adult dependent would be an elderly parent not capable of self-care who has the same principle residence as the employee. A DC-FSA provides tax savings because employees don’t pay federal or FICA taxes on the money they put into their account, and many state taxes are also exempt.
A Health Savings Account (HSA) is tax-advantaged medical savings account available to those who are enrolled in a High Deductible Health Plan (HDHP). HSAs are owned by the individual, differentiating them from company-owned Health Reimbursement Arrangements (HRAs) that are an alternate tax-deductible source of funds paired with HDHPs. And, unlike a Flexible Spending Account (FSA), HSA funds roll over and accumulate year over year if not spent, with the ability to earn tax-free interest on the account. HSA funds may be used to pay for qualified medical expenses at any time without federal tax liability.
The Consolidated Omnibus Budget Reconciliation Act of 1985 (COBRA) requires employers with group health plans to offer employees the opportunity to continue temporarily their group health care coverage under their employer’s plan if their coverage otherwise would cease due to termination, layoff, or other change in employment status.
